2. Use License

Permission is granted to access and use Cape Town Mansions for personal property listing and property search purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or copy the materials for unauthorized use
  • use the platform for illegal activities or fraudulent purposes
  • attempt to reverse engineer any software contained on the platform
  • remove any copyright or other proprietary notations from the materials
  • create automated systems to scrape or harvest data from the platform

3. Property Listings

3.1 Listing Accuracy

Property owners are responsible for ensuring that all information provided in their listings is accurate, current, and complete. This includes but is not limited to:

  • Property descriptions and specifications
  • Pricing information
  • Property condition and features
  • Legal status and ownership verification
  • High-quality, recent photographs that accurately represent the property

3.2 Prohibited Listings

The following types of listings are strictly prohibited on our platform:

  • Properties not legally owned by the lister or without proper authorization
  • Properties with disputed ownership or legal issues
  • Duplicate or spam listings of the same property
  • Properties with false or misleading information
  • Properties that violate local zoning or regulatory requirements
  • Commercial properties (residential properties only)

4. User Accounts

4.1 Account Security

Users are responsible for maintaining the security of their accounts and passwords. Cape Town Mansions cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

4.3 Account Termination

We reserve the right to terminate or suspend accounts immediately, without prior notice or liability, for any reason including violation of these Terms and Conditions, fraudulent activity, or abuse of platform services.

5. Payment Terms

5.1 Listing Fees

Property listings on Cape Town Mansions require a one-time payment per listing. We offer regular property listings and featured property listings with enhanced visibility. All listing fees are paid upfront before your property goes live on the platform. Listing fees are non-refundable once your property has been approved and published. Pricing updates will not affect properties which have already been paid for and published.

5.2 Payment Processing

All payments are processed securely through PayHere payment gateway. By using our payment services, you agree to PayHere’s terms and conditions. Cape Town Mansions does not store or have access to your payment card information.

5.3 Refund Policy

Listing fees are non-refundable once payment is processed, except in cases where Cape Town Mansions fails to publish an approved listing due to technical issues on our platform.

6. Privacy and Data Protection

6.1 Personal Information

We collect and process personal information in accordance with our Privacy Policy and applicable data protection laws, including the Protection of Personal Information Act (POPIA) in South Africa.

6.2 Data Security

We implement appropriate technical and organizational measures to protect personal information against unauthorized access, alteration, disclosure, or destruction.

6.3 Contact Information

By listing your property, you consent to display your contact information to potential buyers and to receive inquiries through our platform.

7. Platform Availability

7.1 Service Availability

While we strive to maintain continuous platform availability, Cape Town Mansions does not guarantee uninterrupted access. We may perform maintenance, updates, or experience technical issues that temporarily affect service availability.

7.2 Listing Duration

Property listings remain active until the property owner removes them or the account is terminated. Featured listings maintain their enhanced visibility for the duration specified at the time of purchase.

8. Disclaimer

The materials on Cape Town Mansions are provided on an ‘as is’ basis. Cape Town Mansions makes no warranties, expressed or implied, regarding the accuracy of property information, the success of property sales, or the quality of inquiries generated. We disclaim all warranties including merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

9. Limitations of Liability

In no event shall Cape Town Mansions be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of profits, failed property sales, or business interruption. Our total liability shall not exceed the amount of listing fees paid for the specific property in question.

10. User Conduct

Users agree to:

  • Provide truthful and accurate information
  • Respect other users’ privacy and property rights
  • Use the platform in accordance with applicable laws
  • Not engage in harassment, spam, or fraudulent activities
  • Not attempt to circumvent our payment systems

11. Intellectual Property

Cape Town Mansions retains ownership of all platform design, software, and proprietary content. Property listings and photographs remain the intellectual property of the respective property owners, who grant Cape Town Mansions license to display such content for listing purposes.

12. Third-Party Links

Cape Town Mansions may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of service of any third-party sites. Use of linked websites is at your own risk.

13. Modifications

Cape Town Mansions may revise these Terms and Conditions at any time with 30 days notice to users. Continued use of the platform after such modifications constitutes acceptance of the updated terms.

14. Dispute Resolution

Any disputes arising from the use of Cape Town Mansions shall first be addressed through good faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration in Cape Town, South Africa.

15. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of South Africa. You irrevocably submit to the exclusive jurisdiction of the courts in Cape Town, South Africa.
